By downloading, accessing, or using Phrazy AI ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Phrazy AI is a language learning application that provides:

• Daily phrases in multiple languages (German, Spanish, French, Italian, Portuguese, and Korean)
• AI-powered pronunciation practice and feedback
• Progress tracking and gamification features
• Premium subscription features

3. Account Registration

3.1 Account Creation

To use certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Accept responsibility for all activities under your account

3.2 Account Security

You are responsible for maintaining the confidentiality of your account. Notify us immediately of any unauthorized access.

4. Subscription and Payments

4.1 Free and Premium Tiers

Phrazy AI offers both free and premium subscription tiers. Premium features require a paid subscription.

4.2 Subscription Terms

• Billing: Subscriptions are billed through the Apple App Store
• Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Price Changes: We may change subscription prices with notice; changes apply at your next renewal

4.3 Cancellation

You may cancel your subscription at any time through your app store settings. Access continues until the end of the current billing period.

4.4 Refunds

Refund requests are handled according to the policies of the App Store. We offer a 30-day money-back guarantee for annual and lifetime purchases - contact support@phrasyai.com.

5. User Conduct

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Reverse engineer, decompile, or disassemble the App
• Transmit any viruses or malicious code
• Harass, abuse, or harm others
• Use automated systems to access the App
• Circumvent any usage limitations or restrictions
• Share your account with others
• Use the App in any way that could damage our reputation

6. Intellectual Property

6.1 Our Content

All content in Phrazy AI - including phrases, audio recordings, images, text, and software - is owned by us or our licensors and protected by copyright and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial language learning purposes.

6.3 User Content

You retain ownership of any content you create (such as voice recordings). By using the App, you grant us a license to process your recordings for providing pronunciation feedback.

6.4 Restrictions

You may not:

• Copy, modify, or distribute our content
• Use our content for commercial purposes
• Remove any copyright or proprietary notices
• Create derivative works from our content

7. Voice Recording and AI Processing

7.1 Consent

By using the pronunciation practice feature, you consent to:

• Recording of your voice
• Transmission of recordings to our servers
• Processing by AI systems for feedback
• Temporary storage during processing

7.2 Data Handling

Voice recordings are processed in real-time and not permanently stored. See our Privacy Policy for details.

8. Third-Party Services

The App integrates with third-party services including:

• Firebase (authentication, database)
• OpenAI (pronunciation analysis)
• App Store (payments)

Your use of these services is subject to their respective terms and policies.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 No Guarantee of Results

We do not guarantee that using Phrazy AI will result in any particular level of language proficiency. Results vary based on individual effort and consistency.

9.3 Availability

We do not guarantee uninterrupted or error-free access to the App. We may modify, suspend, or discontinue features at any time.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHRAZY AI AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Any damages exceeding the amount you paid us in the past 12 months

This limitation applies regardless of the theory of liability.

11. Indemnification

You agree to indemnify and hold harmless Phrazy AI and its affiliates from any claims, damages, losses, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights

12. Termination

12.1 By You

You may stop using the App and delete your account at any time.

12.2 By Us

We may suspend or terminate your access if you:

• Violate these Terms
• Engage in fraudulent activity
• Abuse the Service or other users

12.3 Effect of Termination

Upon termination, your license to use the App ends. Provisions that by their nature should survive termination will survive.

13. Dispute Resolution

13.1 Informal Resolution

Before filing any legal claim, you agree to try to resolve disputes informally by contacting support@phrasyai.com.

13.2 Arbitration

Any disputes not resolved informally will be resolved through binding arbitration, except for claims that may be brought in small claims court.

13.3 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.

14. Changes to Terms

We may update these Terms at any time. Material changes will be notified through the App or via email. Continued use after changes constitutes acceptance.

15. General Provisions

15.1 Entire Agreement

These Terms constitute the entire agreement between you and Phrazy AI regarding the App.

15.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

15.3 No Waiver

Our failure to enforce any right does not waive that right.

15.4 Assignment

You may not assign these Terms. We may assign them in connection with a merger or acquisition.

15.5 Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
